The Texas State Board of Dental Examiners (Board) files this Notice of Intent to Review to consider for re-adoption, revision, or repeal the chapters listed below, in their entirety, contained in Title 22, Part 5, of the Texas Administrative Code. This review is being conducted in accordance with Texas Government Code §2001.039.

Rule Chapters Under Review

Chapter 117, Faculty and Students in Accredited Dental Schools

Chapter 119, Special Areas of Dental Practice

Chapter 125, Applications for Special Consideration or Exception to Board Rules

During the review, the Board will assess whether the reasons for adopting or readopting the rules in these chapters continue to exist. The Board will review each rule to determine whether it is obsolete, whether the rule reflects current legal and policy considerations, and whether the rule reflects current Board procedures. This review is required every four years.

The proposed rules will be open for public comment before final adoption by the Board in accordance with the requirements of the Administrative Procedure Act, Texas Government Code, Chapter 2001.

The State Board for Educator Certification (SBEC) adopts the review of 19 Texas Administrative Code (TAC) Chapter 235, Classroom Teacher Certification Standards, Subchapter A, General Provisions; Subchapter B, Early Childhood Certificate Standards; Subchapter C, Classroom Teacher Pedagogy Standards, Early Childhood-Grade 12; Subchapter D, Trade and Industrial Workforce Training Certification Standards; Subchapter E, Science of Teaching Reading Standards; and Subchapter F, Supplemental and Special Education Certificate Standards, pursuant to Texas Government Code (TGC), §2001.039. The SBEC proposed the review of 19 TAC Chapter 235 in the March 13, 2026 issue of the Texas Register (51 TexReg 1719).

Relating to the review of 19 TAC Chapter 235, the SBEC finds that the reasons for the adoption continue to exist and readopts the rules. The SBEC received no public comments related to the review of Chapter 235.

This concludes the review of 19 TAC Chapter 235.

The SBEC proposed the review of 19 TAC Chapter 241 in the March 13, 2026 issue of the Texas Register (51 TexReg 1719).

Relating to the review of 19 TAC Chapter 241, the SBEC finds that the reasons for the adoption continue to exist and readopts the rules. The SBEC received no public comments related to the review of Chapter 241.

State Board for Educator Certification

The State Board for Educator Certification (SBEC) adopts the review of 19 Texas Administrative Code (TAC) Chapter 242, Superintendent Certificate, pursuant to Texas Government Code (TGC), §2001.039. The SBEC proposed the review of 19 TAC Chapter 242 in the March 13, 2026 issue of the Texas Register (51 TexReg 1719).

Relating to the review of 19 TAC Chapter 242, the SBEC finds that the reasons for the adoption continue to exist and readopts the rules. Following is a summary of the public comments received and the SBEC's responses related to the review of Chapter 242.

Comment: Texas community members and representatives from Texas TransformEd expressed support for a previous petition for rulemaking related to 19 TAC Chapter 242. The commenters encouraged the State Board for Educator Certification (SBEC) to add an executive leadership track for non-traditional superintendent candidates under an approved educator preparation program (EPP). Commenters stated that this new, alternative route would allow EPPs to admit candidates to a program while the candidate concurrently completes any remaining graduate studies required by 19 TAC §242.20, Requirements for the Issuance of Standard Superintendent Certificate.

Response: This is outside the scope of the proposed rule review. The referenced petition for rulemaking was presented to the SBEC in December 2025, and the SBEC voted to deny the petition.

The Texas Health and Human Services Commission (HHSC), in its own capacity and on behalf of the Texas Department of State Health Services (DSHS), adopts the review of the chapter below in Title 25, Part 1, of the Texas Administrative Code (TAC):

Chapter 97, Communicable Diseases

Notice of the review of this chapter was published in the February 27, 2026, issue of the Texas Register (51 TexReg 1313) for public comment.

The 31-day comment period ended March 30, 2026. During this period, HHSC did not receive any comments regarding the proposed rule review.

HHSC has reviewed Chapter 97 in accordance with Texas Government Code §2001.039, which requires state agencies to assess, every four years, whether the initial reasons for adopting a rule continue to exist.

The agency determined that the original reasons for adopting all rules in the chapter continue to exist and readopts Chapter 97. Any amendments, if applicable, to Chapter 97 identified by HHSC in the rule review will be proposed in a future issue of the Texas Register.

This concludes HHSC's review of 25 TAC Chapter 97 as required by Texas Government Code §2001.039.

Notice of the review of this chapter was published in the March 13, 2026, issue of the Texas Register (51 TexReg 1720) for public comment.

The 31-day comment period ended April 13, 2026. During this period, HHSC did not receive any comments regarding the proposed rule review.

HHSC has reviewed Chapter 566 in accordance with Texas Government Code §2001.039, which requires state agencies to assess, every four years, whether the initial reasons for adopting a rule continue to exist.

The agency determined that the original reasons for adopting all rules in the chapter continue to exist and readopts Chapter 566. Any amendments, if applicable, to Chapter 566 identified by HHSC in the rule review will be proposed in a future issue of the Texas Register.

This concludes HHSC's review of 26 TAC Chapter 566 as required by Texas Government Code §2001.039.

The department has reviewed these chapters in accordance with Texas Government Code §2001.039, which requires state agencies to assess every four years whether the initial reasons for adopting a rule continue to exist. The department has determined the reasons for adopting these rules continue to exist.

Any necessary amendments or repeals identified during the rule review process will be proposed in a future issue of the Texas Register and will be open for public comment prior to final adoption by the department, in accordance with the requirements of the Administrative Procedure Act, Texas Government Code, Chapter 2001.

This concludes the department's review of 37 TAC Part 1, Chapters 2, 3, 8, 9, 14 - 16, 23, 25, 35, and 37.
